Terms of Service

Welcome to tyneskin.ca (the "Site"), operated by TYNE Skin Inc. ("TYNE," "we," "us," or "our"), a corporation incorporated under the laws of Canada with its principal place of business in Edmonton, Alberta. By accessing or using the Site, or by placing an order, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

1. Use of the Site

You may use the Site only for lawful purposes. You agree not to interfere with the Site's operation, attempt to gain unauthorized access to any systems, scrape or harvest content or data, or use the Site in any way that violates applicable law.

2. Products

Our products are cosmetics intended for external, topical use as directed. They are not drugs or natural health products and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Nothing on the Site constitutes medical advice. If you have a skin condition, are pregnant or nursing, or have concerns about an ingredient, consult a qualified healthcare professional before use. We recommend performing a patch test before first use and discontinuing use if irritation occurs.

Full ingredient lists are published on each product page. It is your responsibility to review them for known allergies or sensitivities.

3. Orders and Payment

All prices are listed in Canadian dollars (CAD) and are exclusive of applicable taxes, which are calculated at checkout. We accept the payment methods displayed at checkout, processed securely by our payment providers.

Placing an order constitutes an offer to purchase. We reserve the right to accept, refuse, or cancel any order at our discretion, including in cases of suspected fraud, pricing or listing errors, or product unavailability. If we cancel an order after payment, you will receive a full refund.

We make every effort to display product information, pricing, and imagery accurately, but errors may occur. We reserve the right to correct errors and update information at any time without prior notice.

4. Shipping

We currently ship within Canada only. Shipping options, costs, and estimated delivery times are described on our Shipping & Returns page and at checkout. Delivery estimates are provided in good faith but are not guaranteed; TYNE is not responsible for carrier delays.

5. Returns and Refunds

Returns and refunds are governed by our Refund Policy, which forms part of these Terms.

6. Intellectual Property

All content on the Site — including the TYNE name and logo, product names, text, graphics, photographs, videos, and design — is owned by or licensed to TYNE Skin Inc. and is protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

7. Reviews and Submissions

If you submit reviews, comments, photos, or other content to us or the Site, you grant TYNE a non-exclusive, royalty-free, perpetual licence to use, reproduce, and display that content in connection with our business, including on the Site and in marketing materials. You represent that your submissions are your own, are accurate, and do not violate the rights of any third party. We may remove or decline to publish any submission at our discretion.

8. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Third-Party Links

The Site may contain links to third-party websites or services. We do not control and are not responsible for their content, policies, or practices.

10. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, TYNE disclaims all warranties, express or implied, regarding the Site, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Individual results from cosmetic products vary.

11. Limitation of Liability

To the maximum extent permitted by applicable law, TYNE Skin Inc., its directors, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable Canadian consumer protection law.

12. Indemnification

You agree to indemnify and hold harmless TYNE Skin Inc. from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site.

13. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute will be subject to the exclusive jurisdiction of the courts of Alberta, except where applicable consumer protection law provides otherwise.

14. Changes to These Terms

We may update these Terms from time to time. The version posted on the Site at the time of your order applies to that order. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
